This is a pretrial appeal by the state, pursuant to Minn. R. Crim. P. 29.03, from an order of the district court suppressing evidence and then dismissing the prosecution of the defendant for the gross misdemeanor offense of aggravated driving while under the influence, Minn. Stat. ? 169.121, subd. 3(a) (1982). The basic issue raised is whether the trial court erred in ruling that the police violated defendants Fourth Amendment rights in stopping him. We reverse and remand for trial.
