If a defendant is convicted of assault with a dangerous weapon, Minn. Stat. Γ§ 609.222, subd. 1(1992), the trial court may
not base a durational departure from the presumptive sentence on the fact that defendant inflicted "substantial bodily harm"
and therefore could have been convicted of the more serious offense, assault with a dangerous weapon resulting in infliction
of "substantial bodily harm," Minn. Stat. Γ§ 609.222, subd. 2(1992). Considered and decided by the court en banc without oral argument.
